CONDITIONS OF SALE AND RETURN POLICY

SCOPE

These General Conditions of Sale apply to all business relations between GroveCommerce (also called "Coffee Capsules Inc.", "Gourmesso", "the Company", "We", "Us", "Our") as the operator of www.gourmesso.com, and its customers, as defined at the time of conclusion of the contract.

CONCLUSION OF CONTRACT

The presentation of products in our online shop does not imply a binding offer, but a non-binding online catalog. By clicking the [Buy/Purchase] button, you agree to a binding order of all goods in the shopping cart.

ORDER CONFIRMATION

Confirmation of receipt of the order is provided by automated email after sending the order and does not constitute an acceptance of a contract at that stage. Acceptance of your order is confirmed either by sending you a separate order confirmation by email or by processing the order and initiating shipment within 1-2 business days.

VERIFICATION OF MERCHANDISE

It is your responsibility to verify the quantity and condition of the merchandise upon delivery. In case you observe damage or missing items, you must notify and file claim with the carrier and inform us within 7 days after delivery. We shall in such a case provide you with identical replacement merchandise.

CANCELLATION AND RETURN INSTRUCTIONS

You have the right to cancel your order in text form (letter, fax, e-mail) or return any merchandise that does not suit you within 14 days after receipt of the order. We will only accept returns of merchandise in their original condition and packaging accompanied by the invoice. When returns are properly completed, we shall reimburse the price of the returned merchandise and the invoiced delivery charges within a maximum of 30 days upon reception of the returned merchandise. The return postage will be at your expense. Refunds will be made in the form of the original payment.

Special Note in regards to Returns for orders using "Buy with Prime (an Amazon Service) on our websites.

This website may offer certain products via Buy with Prime (an Amazon service). In case of a return request for an order that was placed via Buy with Prime, please follow the below steps. 

Step 1 - Open the order confirmation email and choose View Order.

Step 2 - Choose Order Details to see the order details page.

Step 3 - Choose Return on the order details page.

Note: The Return button appears only after the order is delivered.

Step 4 - Enter any additional information about the return, such as the reason for the return.

Step 5 - Confirm the estimated refund amount and summary of the return details to create the return. When the return has been created, a return confirmation email is sent.

Step 6 - From the return confirmation email, choose Print Return Label, and then attach the printed label to the package.

Step 7 - Drop the return off at the location listed on the return label.  

RETURN SHIPMENT COST COVERAGE AGREEMENT

If you as the consumer exercise your right of cancellation or return, you shall bear the costs of the return shipment. However, GroveCommerce will bear the costs of the return shipment in all cases when the wrong merchandise was delivered and in cases when only a partial order was sent.

GIFT CARDS

No refunds are permitted with respect to Gift Cards and eGift Cards; all sales are final. However, you may be permitted to cancel a Gift Card or eGift Card purchased prior to its delivery to a recipient.

PRICES AND SHIPPING RATES

The prices are valid at the time ordering. The period of validity of our limited offers can be found where they are illustrated on the Website. All prices exclude sales tax (if applicable) unless stated otherwise and exclude shipping costs.

Orders with a value of $50 or more qualify for free shipping within the continental U.S. For orders below $50, we will charge a fee for postage and packaging depending on the selected shipping option, regardless of the number of packages or the size and weight of the order.

If for technical or logistical reasons a shipment is made in several installments, we will only charge for one delivery unless we previously communicate it otherwise.

DELIVERY

GroveCommerce shall deliver the ordered goods to the address provided by the customer. In case of delays in delivery, we shall inform you immediately.

For deliveries outside of the United States, the customer shall bear the customs duty, taxes or any other additional fees.

RESERVATION OF TITLE

Until complete payment is received, the goods shall remain the property of GroveCommerce

PAYMENT, MATURITY, DEFAULT

We accept a variety of payments for your order (e.g. PayPal or Credit/Debit Card). We retain the right only to accept certain payment methods in individual cases. Unfortunately, we cannot accept payment by cash or check. We do not accept liability for any losses.

Should you default on your payments, we retain the right to charge you additional interest or reminder fees.

When redeeming a voucher and/or coupon code, please note the specific redemption conditions, such as minimum order quantity, validity, etc. Only one voucher and/or coupon code, or customer-related reduction, may be redeemed per order. Voucher and/or coupon codes cannot be exchanged for cash and no change will be given when the full value is not used. Resale of vouchers and/or coupon codes is not allowed.
